Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. This Sweepstakes is intended for viewing and participation in the 50 United States and the District of Columbia (“U.S.”) only and shall only be construed and evaluated according to U.S. law. Do not enter this Sweepstakes if you are not, at the time of entry (i) a legal U.S. resident located in the U.S., and (ii) age 18 or older. Sweepstakes begins at approximately 7:30 a.m. (Miami time) on June 1, 2023 and ends at 5:00 p.m. (Miami time) on August 7, 2023.
How to Enter this Sweepstakes:
This Sweepstakes is open to individuals aged 18 or older who register their child(ren) for Summer Camp 2023 at Frost Science. You may enter the Sweepstakes by registering at the Summer Camp website at frostscience.org/summercamp. One winner will be chosen per Summer Camp week for a total of nine winners. All registered camp participants will be entered to win per week. The winners will be notified via phone or email to the camper’s caregivers.
Entries:
Sponsor is not responsible for any entry errors or failures, regardless of whether they are human or technical in nature. Sponsor is also not responsible for incorrect or inaccurate entry of information, whether caused by Internet users, or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error that may occur in the processing of the entries in the Sweepstakes.
All required action must be completed to enter. No purchase is necessary to claim a prize. Limit one Sweepstakes entry form per person. By entering, all participants agree to be bound by the official rules of these Sweepstakes. For a copy of the official rules, send a self-addressed stamped envelope to Summer Camp Frost Science Registration Giveaway, Official Rules, Frost Science, 1101 Biscayne Boulevard, Miami, Florida 33132, by August 7, 2023. Vermont residents may omit return postage.
Eligibility:
This Sweepstakes is open only to individuals who, at the time of entry, are registered for Summer Camp 2023 at Frost Science. Employees, officers, and trustees of the Phillip and Patricia Frost Museum of Science, Inc., d/b/a: Frost Science and its onsite vendors, and advertising and promotion agencies, as well as the immediate family members and/or persons living in the same households of each, are not eligible for this Sweepstakes. This Sweepstakes is void where prohibited.
Drawings:
The winner will be selected in a random drawing conducted at the culmination of each week of Summer Camp 2023 from among all registered campers. Judges’ decisions are final and binding in all matters relating to this Sweepstakes. ODDS OF WINNING ARE BASED UPON THE NUMBER OF ELIGIBLE CAMPERS REGISTERED PER WEEK. Winners will be notified via email and/or phone.
Prize:
One winner will receive a $100 gift card to the Science Store at Frost Science per week of Summer Camp. Gift card can only be redeemed onsite at the Science Store and is not available online. A physical gift certificate will be given to the camper’s caregiver for redemption. The winner may be required to sign and return an affidavit of eligibility and a liability and publicity release, or Prize will be forfeited and awarded to an alternate winner. The Prize will be awarded to verified winner.
Total approximate retail value of the Prize is $100.00. If total purchase at the Science Store exceeds the value of the gift card, the remaining balance of the total purchase must be paid by the purchaser. This card cannot be exchanged or returned for cash, check, or credit. Gift card has no cash value and is non-transferable. Gift card value may be subject to expiration.
Frost Science reserves the right to immediately invalidate gift card, without notice, should it receive a credit card chargeback or other form of repudiated payment made towards the qualifying Summer Camp purchase. Reasonable and prudent steps are taken to verify the legitimacy of a redeemer and upon full redemption or at the expiration date, the gift card will be considered as no longer valid for payment of any kind. Frost Science reserves the right to dishonor the gift card, if it reasonably believes it was not validly purchased, has already been redeemed, or the redeemer stole or is otherwise not the intended beneficiary. Gift card is not valid or redeemable after the expiration date indicated within these terms and conditions.
Waiver, Release, and Indemnity:
By entering the Sweepstakes, participants agree to release and indemnify the Phillip and Patricia Frost Museum of Science, Inc., and their respective retailers, distributors, advertising, and promotion agencies, as well as each of their respective directors, trustees, officers, employees, and shareholders, from any and all liability, loss, damage, or injuries of any kind sustained in connection with their participation in the Sweepstakes or from their acceptance, receipt, possession, and/or use or misuse of any prize, or for any typographical or other error in the printing, offering, or announcement of any prize.
IN NO EVENT WILL ANY OF THE FOREGOING ENTITIES OR INDIVIDUALS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SWEEPSTAKES. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
Participants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee expressed or implied, in fact or in law, relative to any prize, including, but not limited to, its quality or fitness for a particular purpose.
Publicity Release:
By accepting a prize, the winner agrees to the use of his/her name, likeness, voice, and/or biographical information by Sponsor, or any party authorized by Sponsor, for advertising and promotional purposes, without additional compensation, except where prohibited by law. Entries become the property of the Sponsor and will not be returned.
Applicable Law; Arbitration:
This Sweepstakes is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to the conflict of laws, and any matters or proceedings which are not subject to arbitration as set forth in these rule and/or for entering any judgment on an arbitration award, shall take place in the State of Florida, in the City of Miami.
The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules and/or this Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or this Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Florida, in the City of Miami, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
If any provisions of these Official Rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision.
General:
All taxes and any other fees or costs associated with the Prizes are the sole responsibility of the winner. The Prize is nontransferable, and no substitutions or cash redemptions will be made, except as provided herein. In the event the Prize is unavailable, Sponsor reserves the right to award a prize of equal or greater value. The winners will be required to sign and return an affidavit of eligibility and a liability and publicity release within 5 calendar days of the date when such documents are sent to winner, or prize will be forfeited and awarded to an alternate winner. The Prizes will be awarded to verified winners.
In the event of noncompliance with these Official Rules, if a winner cannot be reached at the e-mail address in winner’s entry form within 5 calendar days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, the particular prize will be forfeited, and an alternate winner will be selected.
Sponsor is not responsible for any damage to a participant’s system that is occasioned by participating in this Sweepstakes or by downloading any information necessary to participate in the promotion.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, theft, or destruction, or unauthorized access to, or alteration of, entries. Entries that have been tampered with are void. Sponsor reserves the right to disqualify any participant who Sponsor determines, in its sole discretion, has threatened the operation of this Sweepstakes or website, or violates these Official Rules. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should viruses, bugs, or other causes beyond Sponsor’s control corrupt the administration, security, or proper play of this Sweepstakes. All federal, state, and local laws apply.
